The New York Post has done an extensive interview with subway hero Daniel Penny:
Ex-Marine Daniel Penny insisted to The Post Saturday that the chokehold killing of Jordan Neely had nothing to do with race — and everything to do with a broken system “that so desperately failed us.”
In his first public comments since the caught-on-video May 1 tragedy on an F train, Penny was both soft-spoken and stoic about being at the center of a political and racial firestorm, as he faces criminal charges that could send him to prison for up to 15 years.
“This had nothing to do with race,” said Penny, 24, sitting under a gazebo at Argyle Park in Babylon, not far from the Long Island beaches where he grew up surfing.
Dressed in black slacks, a blue zip-up jacket and beat-up Vans sneakers, Penny didn’t flinch when asked about Neely, a black, 30-year-old mentally ill homeless man.
“I judge a person based on their character. I’m not a white supremacist.
“I mean, it’s, it’s a little bit comical. Everybody who’s ever met me can tell you, I love all people, I love all cultures. You can tell by my past and all my travels and adventures around the world. I was actually planning a road trip through Africa before this happened.”
He is not a vigilante, Penny said. “I’m a normal guy.”

I believe everything the guy is saying, including that he was planning a trip through Africa before he was hit with these charges. He has pictures of himself with smiling brown people.
Of course, I also have a lot of pictures of myself with smiling brown people in third world countries, and have actually toured Africa – and currently live in Africa – and this has never prevented me from being called a “white supremacist.”

Penny’s defense is similar to that of Kyle Rittenhouse. But Kyle was facing a different kind of jury.
Penny will most likely go to prison for 10 years for defending people from a dangerous black criminal.
You’ll recall that before the election, I told you very clearly this would be the policy of the Democrats.
I would like to see Trump make this guy a big part of his campaign. I don’t know if he can actually pardon him, since these are not federal charges. But we need to talk about the problem with these blacks and, more importantly, the problem with the system that enables them to hurt others.

We have very different definitions of “hero”. Choking to death a vagrant doesn’t fit mine.
Maybe I have watched too many movies which there is a scene in a prison, involving “revenge” by a gang against a wrongly despised fellow prisoner. But it seems to me that if Mr. Penny is sentenced to serve any time whatever, that might well be tantamount to a death penalty, by choke hold. This is surely a factor in the defense strategy. Normally, the defense would accept a plea bargain of, say, 60 days plus probation. Would they in this case, if the 60 days would be served inside a regular prison?
A cynic might argue that the real purpose of Trump’s MAGA stadium extravaganzas was mocking the impotence of white American males, corralled like incontinent, screaming NFL fans in the stands and then running back to their cars in a hail of Antifa insults and spit. Meanwhile, this country’s worst enemies ruled the streets with the tacit approval of the same police only those white American males supported.

So are you claiming that you believe that a Marine, of Penny’s stature and obvious physical strength, could not safely(safe for both parties), restrain the supposed miscreant by using only one hand? I have zero doubt on the matter, and if you assert that you believe that, yes, Penny could not have held Neely with one hand I do not believe you. Of course he could and so could all Marines. Marines are not only tough guys but they are trained.
This case is not analogous with the Rittenhouse case at all. Rittenhouse was 100% in the right, not only legally, but morally as well. Rittenhouse did not use any force against anyone until he was attacked, and even then he acted correctly by trying to physically retreat from the attack. Rittenhouse did not use force until he had no other option.
Penny, on the other hand, attacked Neely from behind and held him in a dangerous manner for several minutes. It is quite possible that restraining Neely was the right thing to do, but in so doing Penny should have used force in a way such as to minimise bodily harm. Being a strong, trained, Marine he could have done so and should have.
Penny’s Marineiness will not work in his favour in this case, as it means he could have carried out the restraint much more safety than an average Joe, instead of much more dangerously.
I certainly hope that the prosecution does not bring ‘race’ into the case. That would be a grave mistake. Penny’s views on race are irrelevant. No matter the permutation* of the races, the issue is the use of grossly excessive force.

The only meaningful criterion for a jury ought to be whether Daniel Penny’s fear that Neely would do people and property harm was comparable to the fear that “hero” Capitol Police officer Lt. Michael Byrd, the man who murdered unarmed demonstrator Ashli Babbitt in cold blood, had in the situation where he took a life. By the Byrd standard of post-murder media and judicial celebration, Penny should get a directed verdict of acquittal, a million bucks, and an invitation to address a joint session of Congress.

Ian Cranston found guilty after defending his girlfriend and himself from ongoing attack from a self confessed predator, Barry ‘If your boyfriend white you single to me’ Washington.
Penny’s case is much more like Cranston’s than Zimmerman’s or Rittenhouse’s. But much less defendable because neither he nor anyone else had been physically attacked and probably not even threatened.
The Penny’s prosecuting authority must not turn the case into a ‘race’ case by using a black prosecutor. A white prosecutor must be used if they wish to obtain a, deserved, conviction.
