Elon Musk calls himself a “free speech absolutist.”
But a judge just threw out X Corp’s lawsuit against the @CCDHate because it was about “punishing the defendants for their speech.”
It’s a big win for CCDH — and a big ol’ embarrassment for Musk.

This lawsuit was always problematic.
A suit against the ADL would have made more sense. He threatened that and then sued this other much smaller group instead. The ADL actually has all of these connections to advertisers and openly threatens to defame them as “supporters of Nazis” if they don’t stop ads. It’s clearly a type of extortion.
But I suppose a suit against the ADL probably would have been thrown out as well.
A U.S. judge on Monday threw out Elon Musk’s lawsuit against a nonprofit group that faulted him for allowing a rise in hate speech on his social media platform X, formerly Twitter.
U.S. District Judge Charles Breyer in San Francisco said it was “evident” that Musk’s X Corp sued the Center for Countering Digital Hate (CCDH) because he didn’t like its criticism, and thought its research would hurt X’s image and scare advertisers away.
“X Corp has brought this case in order to punish CCDH for CCDH publications that criticized X Corp–and perhaps in order to dissuade others who might wish to engage in such criticism,” Breyer wrote.
“It is impossible to read the complaint and not conclude that X Corp is far more concerned about CCDH’s speech than it is its data collection methods,” he added.

X accused the center of breaching its 2019 user contract by scraping and cherry-picking data to create false and misleading reports that Musk turned X into a haven for hate speech, extremism and misinformation.
According to X’s complaint filed last July, the nonprofit designed its “scare campaign” to drive away advertisers, and caused tens of millions of dollars in damages.
X had argued that the nonprofit was bound by Musk’s policy changes, and could have left Twitter if it didn’t like them.

Musk’s own speech has often also drawn complaints.
In November 2023, Musk endorsed an antisemitic post on X that said members of the Jewish community were stoking hatred against white people, saying the user spoke “the actual truth.”
Musk has denied being antisemitic and sought to make amends, including in a January visit to the former Nazi death camp Auschwitz in southern Poland.
The visit to Auschwitz was just symbolic, a signal that he would begin censoring more, which he has done.
The whole thing is schizophrenic. There was no way he was going to institute free speech on Twitter and that not result in:
- More criticism of the Jews, and
- The ADL and other Jewish groups throwing fits
It was very obvious this would happen. He even made the purchase in the midst of the initial Kanye West debacle.
It’s inexplicable that Elon would claim he didn’t know this was going to happen.
Everyone just assumed that the only way he would do it in the first place was if he was ready to push back on the ADL, then he totally crumbled.
He’s a yipper. Everyone knows this now.

It seems pretty clear the activity of CCDH in compiling and publishing what they considered ‘hate’ found on Twtter/X was aimed at punishing Twitter/X/Musk for allowing it, and this is true whether or not CCDH actively circulated their report themselves, including making sure companies advertising on Twitter/X knew about it — you have to be extraordinarily naive and dishonest to believe otherwise.

Think about it: the decision basically says that an activist group like CCDH can put out a report with the intent of materially harming the business interests of Twitter/X by triggering advertisers to boycott the platform (‘independent acts’), and there is no legal remedy at all for that, even though the ‘speech’ on Twitter/X that CCDH didn’t like, calling it ‘hate’, was perfectly legal and so protected by the First Amendment.
The best way to deal with (((Musk))) and his (((Trumpanzee))) fanboys is to legislate them out of the public square. Good on these guys.

“It is my solemn duty to report on the worst of what humanity is capable of and to present my findings,” Francesca Albanese, the UN Special Rapporteur on human rights in the Occupied Territories, told the UN Human Rights Council on Tuesday. The Italian lawyer is one of dozens of independent human rights experts mandated by the UN to report and advise on specific themes and crises.
The UN expert wrote that she found “reasonable grounds to believe” that the “threshold indicating the commission of the crime of genocide against Palestinians as a group in Gaza has been met”.
“I implore member states to abide by their obligations, which start with imposing an arms embargo and sanctions on Israel and so ensure that the future does not continue to repeat itself,” she said.
The report, “The Anatomy of a Genocide”, writes that after “five months of military operations, Israel has destroyed Gaza”. It notes that over 30,000 Palestinians have been killed, including more than 13,000 children.
At least 71,000 Palestinians have also been injured, the report says, with many receiving “life-changing mutilations”. At least 70% of residential areas have also been destroyed, and 80% of the whole population has been “forcibly displaced”.
“This report concludes that there are reasonable grounds to believe that the threshold indicating Israel’s commission of genocide is met,” the report writes. “One of the key findings is that Israel’s executive and military leadership and soldiers have intentionally distorted jus in bello principles, subverting their protective functions, in an attempt to legitimize genocidal violence against the Palestinian people.”

The First Amendment only prohibits government from restricting freedom of expression — but in a case like this, it is a private entity, an NGO, that is effectively trying to limit expression by harming the viability of Twitter/X as a business, simply because the platform allows forms of expression the NGO finds objectionable, calling it ‘hate’ in order to create prejudice against it in the public conscience.
In his weekly talks, William Luther Pierce mentioned the campaign against free speech many times, and how it relied on labeling some forms of speech ‘hate’ — he saw this as a consequence of the feminization of society, meaning the idea that some groups, or society in general, must be protected from the harm some speech may cause is fundamentally a feminine notion, whereas wanting to protect the right to free expression is more masculine.
In several recent comments, I said there is the letter of something, and the spirit — the letter of the right to free speech is embodied in the First Amendment, which only prohibits government from restricting expression — as is now obvious, and as this case very clearly shows, respect for the spirit of free speech in American society has declined significantly over the previous few decades.
I don’t see this as a fixable problem.
We have a matriarchal society now.
Indeed, it comes down to matriarchal versus patriarchal administration, the latter of which is more in keeping with the natural order of things. This isn’t to say that women aren’t capable of doing many things men do, but that society functions best when women fulfill their natural role as wives and mothers, leaving men to shoulder the myriad obligations of breadwinning and protection only men are fit to shoulder.
Where patriarchal order holds sway, there is more societal stability.

I’m not sure ‘this lawsuit was always problematic’, nor that ‘a suit against the ADL would have made more sense.’
While I have not yet read the full brief filed by Musk, or the full decision, on the surface the suit appears to be about what’s called tortious interference:

It seems pretty clear that efforts like those of CCDH (and the ADL) to publicly highlight ‘hate’ on Twitter/X were aimed at harming the platform as a business in order to pressure Musk to censor the ‘hate’ — like I said, it’s naive and dishonest to believe otherwise — proving this intent in court would be more difficult, even with discovery — yet the suit never got to that stage: the judge simply dismissed it, saying it was about ‘punishing Defendants for their speech’ — no, it seems it was probably more about going after them for their tortious interference in Musk’s business.
Notice also in the carefully worded legal langauge of the amendment the term is “freedom of speech” not “right of free speech.” In eighteenth century usage “freedom” was synonymous with “immunity” or “privilege,” which were traditionally allowable – and revokable – by civil or religious authority. In contrast “rights” were considered natural and inviolable, as the two specified in the next clause of the text. Suppression of free speech soon arrived in the Sedition Law of 1798, criminalizing criticism of the Federalist regime.
Regional oligarchs were leery about granting the new central government so much power, absent specific assurances of civil rights, as they had previously enjoyed under the now all but forgotten 1689 English Bill of Rights, so Madison supplied what appeared to be such guarantees.
Elon should have just created a non-profit for countering those countering Hate Speech.
Call it: “The Center to Protect Free Speech” or “The Free Speech Society”.
Have them battle the Hate Speech zealots.

At the time, more than anything that law probably confirmed longstanding suspicions about federalism and federalists held by anti-federalists — some credit its passage with helping Thomas Jefferson, generally an anti-federalist, win the election in 1800.
I don’t know the significance of the language, ‘freedom of speech’ vs ‘right of free speech’ — as I said before, I think the spirit of the First Amendment is clear, whether or not the language finally chosen reflects something about the letter of it I cannot say — there are surviving records of the debate about the amendments, including letters between delegates, that may shed light on exactly what happened leading up to their final formulation — the thinking and concerns of those involved.
Thank you for providing that important legal distinction. We live in an era where lavishly-funded (and highly-connected) NGOs can effectively regulate and criminalize political discourse via spurious and politicized legalisms. This deception relies on a lot of Jew-centric mumbo-jumbo.

Yes — in addition, while most Americans probably know of the SPLC (it’s amazing how often ordinary news stories cite them as experts on ‘hate’) and the ADL, there are many other non-profits engaged in activism that is best called subversive — in past comments I’ve given attention to so-called ‘dark money pools’, among the worst is the Tides Foundation (very few people know they were behind the successful felon voting initiative in Florida) — these ‘dark money pools’ allow wealthy individuals and foundations to opaquely fund all kinds of things, e.g. LGBTQ advocacy and ‘bail reform’, they would rather not be directly connected to — whenever I see a story involving a 501(c)(3), I look into who funds them (this site is a good starting point) — unfortunately, that moron Trump presided over a change in IRS regulations: these organizations are no longer required to itemize their donors in their publicly available tax filings.
