Disgraced hedge-fund manager Alphonse “Buddy” Fletcher has lost his long-running battle with The Dakota, the iconic New York co-op he sued for racial discrimination in 2011.

A Manhattan judge late Friday granted the co-op’s motion to dismiss the suit.

Fletcher, a longtime Dakota resident, claimed he was discriminated against when the 131-year-old Upper West Side landmark refused to sell him a fifth apartment. …

The dismissal came one day after Fletcher’s wife, Ellen Pao, said she wouldn’t appeal her failed sex discrimination case against her former employer, Kleiner Perkins, because she didn’t have the resources.

I have nothing to say about these particular anti-discrimination cases, but it’s amazing the degree to which anti-discrimination laws have been used to completely undermine constitutionally enumerated rights – freedom of speech, religion, the press, assembly, and property. There is no constitutional right not to be discriminated against by a private entity – none. Thus any anti-discrimination law which compromises those fundamental rights is unconstitutional.

    In law, we don't decide needlessly broad issues. The question here had to be, was there some white tenant with shaky finances to whom they were willing to sell five units? As you well know, in the black mind "discrimination" means "failure to treat me unequally." If all we did was call out and exterminate that formulation, discrimination law woukd be fine.

Don Thompson’s 365 Black vision for McDonalds was all too successful as the image of the venerable hamburger chain became less Ronald McDonald and more Trayvon Martin. Better to take your chances in court with a Buddy Fletcher than put him in charge of clients money. Dick Parsons as CEO of an NBA team makes a lot more sense than CEO of Time Warner. There is only ‘risk’ and no reward with these guys.

    Best be careful bashing on with that "1%" malarkey.

    Because there's bound to be something or other where YOU fall at +2.25 standard deviations. I.e., the top 1% of a standardized distribution.

    Sooner or later someone will discover it, and profit from demonizing it.

    For what it's worth "the 1%" of IQ for white people starts at, what, around 137? (That's with "white" defined so as to include a fairly broad European demographic, including a lot of lower IQ Southern and Eastern Europeans. The Ashkenazim make sure that they only include their fifth or closer cousins when talking about THEIR IQs.)

    And for blacks, "the 1%" of IQ starts between 115 and 120. Far less for "inner city" blacks. (Closer to 105, with a population mean of around 70.)

    There's all kinds of 1 percents.

    Judging from interviews with him, the progress of his fiscal life, and other public facts, I doubt that Fletcher made his 1% moolazillions based on a 1% IQ. Seems something else was at work.

    Probably the same thing that advanced TN Coates, NdG Tyson, and BH Obama to their positions of worship by the masses and concomitant monetary reward. Oh, say, being part of the 13%.

    As mentioned, Fletcher is bankrupt. I thought I had read that the couple have stopped making payments on the apartments. In addition, the IRS just slapped Fletcher with a $1,402,649.33 tax lien.

    As noted this is a 131 year old landmark and how a guy like Buddy Fletcher came to own 4 units there I'll leave to your own imagination. In the current instance the Dakota management wanted to see the 'color' of Buddy Fletcher's money for a multimillion dollar property not a 'note guaranteed by a Cayman Islands corporation backed by a share in a Dubai Development Corporation' or some variation of that swindle. When Fletcher goes bankrupt the Dakota does not want to be in court for years trying to foreclose on their own goddamned property!

  13. What amazes me is that these two professional adventures of the most venal, the most 18th century, the most cinematic kind have found each other and committed to an unholy union. Truth is indeed stranger than fiction. The story of Pao and Buddy would make for the plot of a fine novel.

  26. Fair bet that the presidential pardon business between November 2016 and noon on January 20th, 2017 is going to make Bill Clinton look inert by comparison. And some Eric Holder-like lackey, if not the great Caribbean-American law enforcement paragon himself, will no doubt again be asked to “investigate” potential pardonees in a fair, well-balanced and ultimately appropriately-outcome result. I don’t know where you guys got the idea that Chinese women are supposed to be so beautiful, but as a man who spent most of his life in the San Francisco Bay Area, I can assure you, she’s a pretty typical specimen. If she’s not exactly what Chinese women tend to look like, then she’s only very slightly below the average.

    LOL, Back in San Jose, in either 1998 or '99, my dad spotted some South Asian character doing the exact same thing, right across the street (my dad was looking out the kitchen window). At least that guy had the discretion to leave his offering in some dense foliage, and was apparently unencumbered with any need to wipe, so no toilet paper was left strewn on the street. But he did take a shit outdoors, in broad daylight, on a suburban street filled with owner-occupied tract homes.

    LOL, Back in San Jose, in either 1998 or ’99, my dad spotted some South Asian character doing the exact same thing, right across the street (my dad was looking out the kitchen window). At least that guy had the discretion to leave his offering in some dense foliage, and was apparently unencumbered with any need to wipe, so no toilet paper was left strewn on the street. But he did take a shit outdoors, in broad daylight, on a suburban street filled with owner-occupied tract homes.

    "Self-serving" is a better modifier. More in line with population ecology/genetics as well.

    All groups self-serve. The question is, in what way...and how to rein in that tendency, which among many humans appears to proceed in the direction of greed, corruption, and ultimately the disabling of social evolution.

    Not all populations are equally prone to being 2.25+ standard deviations on the curve of self-serving greed. See M.G. Miles's Those Who Can See blog, the latest entry, on commonweal orientation.

    The framers of the US Constitution well understood this and constituted a governmental system designed both to allow and rein in self interest. As Mr. Franklin put it, "A republic. If you can keep it."

    On the side streets of China this seems to be quite common. I was in Urumqi walking down the street and a kid runs out of a store his parents must have been working at, pulls his pants down, squats on the curb, pulls his pants up and walks back in as though that was natural.

    As noted this is a 131 year old landmark and how a guy like Buddy Fletcher came to own 4 units there I'll leave to your own imagination. In the current instance the Dakota management wanted to see the 'color' of Buddy Fletcher's money for a multimillion dollar property not a 'note guaranteed by a Cayman Islands corporation backed by a share in a Dubai Development Corporation' or some variation of that swindle. When Fletcher goes bankrupt the Dakota does not want to be in court for years trying to foreclose on their own goddamned property!

    As mentioned, Fletcher is bankrupt. I thought I had read that the couple have stopped making payments on the apartments. In addition, the IRS just slapped Fletcher with a $1,402,649.33 tax lien.
